1. Identification and Scope

Throughout these Terms and Conditions, the expressions “Linho Puro”, “we”, “us” or “our” refer to Green Dolphin – Factory Fashion, Lda.
These Terms and Conditions govern access to and use of the Linho Puro website, as well as the purchase of products made available through the online store.
By browsing the website, creating an account or placing an order, the user confirms that they have read and understood these Terms and Conditions.
Acceptance of these terms does not affect any rights granted to consumers by law.
2. E-Commerce Platform
The online store is hosted on the Shopify platform, which provides us with the technological infrastructure required to display and sell our products.
The use of certain store services may also depend on applications, payment providers, carriers and other external service providers.
3. Use of the Website
The user agrees to use the website responsibly and in accordance with the applicable legislation.
The website may not be used for:

illegal or unauthorised purposes;

introducing or transmitting viruses, malicious code or other harmful elements;

attempting to gain unauthorised access to systems;
-
unlawfully collecting the personal data of third parties;
-
sending spam, phishing messages or other fraudulent communications;

reproducing or exploiting content without authorisation;

infringing intellectual property rights;

publishing false, offensive, discriminatory or unlawful content;

interfering with the security or operation of the store.
We may restrict or suspend access to the website where there are reasonable indications of fraudulent or unlawful use, or use that breaches these terms.
4. Minimum Age
Purchases made through the website must be completed by persons who have the legal capacity to enter into contracts.
Where the purchaser is a minor, the purchase must be made or authorised by their legal representative, in accordance with the applicable legislation.
5. Products
The products displayed on the website are subject to availability.
We make every effort to provide product descriptions, images, sizes, colours, materials and other characteristics as accurately as possible.
However, the way colours are displayed may vary depending on the screen, device, lighting or settings used by the customer.
As the products are made from natural materials, such as linen, slight variations in colour, texture, weave, measurements or finish may occur. Where these variations are inherent to the nature of the material and do not affect the normal use of the product, they do not necessarily constitute a defect.
The images used are intended to represent the products but may include decorative elements that are not included in the purchase.
The description available on each product page will specify the items included.
6. Availability
Adding a product to the shopping cart does not constitute a reservation and does not guarantee its availability.
An order will only be deemed accepted after:

the customer completes the purchasing process;
-
payment is authorised or confirmed;
-
Linho Puro sends the order confirmation.
If a product becomes unavailable after the order has been placed, we will contact the customer as soon as possible.
Depending on the circumstances, the customer may choose to:

receive a refund for the unavailable product;
-
choose another product, subject to agreement;
-
wait for the product to be restocked, where this is possible and accepted by the customer.
7. Prices
The prices displayed in the store are stated in euros.
Unless expressly stated otherwise, prices intended for consumers include Value Added Tax at the legally applicable rate.
Shipping costs, where applicable, are displayed separately before the order is completed.
Linho Puro may change product prices at any time, without affecting orders that have already been confirmed.
In the event of an obvious pricing error, the customer will be informed before the order is shipped.
Where the error is clear and easily recognisable as incorrect, Linho Puro may cancel the order and issue a full refund of all amounts paid.
8. Campaigns and Promotions
Campaigns, discounts, promotional codes and other offers are subject to the specific conditions displayed in the store or in the relevant communication.
Unless otherwise stated:

promotional codes cannot be combined;
-
each code may be limited to specific products, customers or periods;
-
discounts cannot be exchanged for cash;
-
campaigns are subject to product availability;
-
a code cannot be applied retrospectively to an order that has already been completed.
Products purchased during a promotion retain all applicable rights relating to returns, withdrawal and the legal guarantee.
9. Ordering Process
To make a purchase, the customer must:

select the desired products;
-
choose the size, colour or other available options;
-
add the products to the shopping cart;
-
confirm the products and quantities;
-
provide the information required for invoicing and delivery;
-
select the shipping method;
-
select the payment method;
-
confirm the order.
Before completing the purchase, the customer will have the opportunity to review and correct the information provided.
After placing the order, the customer will receive an electronic communication containing the relevant details.
The automatic confirmation that the order request has been received does not prevent checks from being carried out in relation to payment, availability, fraud or the accuracy of the information provided.
10. Information Provided by the Customer
The customer agrees to provide complete, up-to-date and accurate information.
The customer is responsible for checking:

their name;

email address;
-
telephone number;
-
billing address;
-
delivery address;
-
postcode;
-
tax identification number, where applicable;
-
selected products, sizes and quantities.
Linho Puro is not responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by the customer.
If the customer identifies an error, they must contact us immediately at info@linhopuro.com.
We cannot guarantee that an order can be changed once it has already been prepared or shipped.
11. Acceptance and Refusal of Orders
We may refuse or cancel an order where there is a legitimate reason, including:

product unavailability;
-
inability to confirm payment;
-
a reasonable suspicion of fraud;
-
clearly incorrect information;
-
an obvious error in the price or description;
-
abusive use of campaigns;
-
attempted unauthorised resale under terms intended for end consumers;
-
inability to deliver to the specified destination;
-
breach of these Terms and Conditions.
Whenever a paid order is cancelled, the amounts due will be refunded.
An order may not be refused on discriminatory grounds or for reasons contrary to the law.
12. Payments
The available payment methods are displayed during checkout.
Payment may be processed by external providers, such as Shopify Payments, PayPal, Stripe, banking institutions or other operators made available in the store.
By selecting a payment method, the customer may also be subject to the terms and conditions of the relevant provider.
The order may not be processed until payment has been authorised or confirmed.
Complete bank card details are processed by payment providers and are generally not stored directly by Linho Puro.
13. Payment Security
Technical measures are used to protect the transmission of payment information.
Despite the measures adopted, no electronic transmission or storage system can guarantee absolute security.
The customer must immediately report any unauthorised use of their account, card or payment method to their payment service provider.
14. Invoicing
The invoice will be issued using the information provided by the customer at the time of purchase.
The customer is responsible for checking the accuracy of the invoicing information before completing the order.
Once an invoice has been issued, changes to certain details may be subject to the limitations established under tax legislation.
15. Delivery
Orders will be delivered to the address provided by the customer.
Available destinations, methods, costs and estimated delivery times will be displayed on the website or during checkout.
The stated delivery times are estimates, unless a binding delivery deadline has been expressly agreed.
Delays may occur for reasons beyond Linho Puro’s reasonable control, including:

carrier-related disruptions;
-
strikes;
-
adverse weather conditions;
-
periods of high demand;
-
customs procedures;
-
incomplete addresses;
-
absence of the recipient;
-
force majeure events.
Where there is a significant delay, the customer should contact us so that we can investigate the situation with the carrier.
16. International Deliveries
Linho Puro may ship orders to Portugal and other European countries, according to the destinations available during checkout.
For deliveries to countries or territories outside the European Union tax area, the following may apply:

customs duties;
-
import taxes;
-
customs clearance fees;
-
customs procedures;
-
other local charges.
Unless otherwise stated, these costs are the responsibility of the recipient.
The customer must check the rules applicable in the destination country.
17. Receipt of the Order
Upon receipt, the customer should check, whenever possible:

the external condition of the packaging;
-
visible signs of damage;
-
missing products;
-
incorrect items;
-
apparent defects.
If the order is damaged or incorrect, the customer must contact us as soon as possible at info@linhopuro.com and provide:
-
the order number;
-
a description of the issue;
-
photographs of the packaging;
-
photographs of the product;
-
any other relevant information.
This communication allows us to assess the situation and find an appropriate solution, without affecting the consumer’s statutory rights.
18. Transfer of Risk
In contracts entered into with consumers, the risk of loss of or damage to the products passes to the consumer when the consumer, or a third party appointed by the consumer other than the carrier, physically receives the products.
Where the carrier is selected directly by the consumer and is not one of the options proposed by Linho Puro, different rules may apply in accordance with the law.
19. Cancellation Before Shipping
The customer may request the cancellation of an order by contacting info@linhopuro.com.
Cancellation will be possible where the order has not yet been processed or shipped.
If the order has already been shipped, the customer may use the returns procedure and exercise the right of withdrawal, where applicable.
20. Right of Withdrawal
The consumer has a legal period of 14 days in which to withdraw from a distance contract without having to provide a reason.
As a general rule, this period begins on the day after the consumer, or a third party appointed by the consumer, takes physical possession of the products.
To exercise this right, the consumer must clearly communicate their decision by email to:

The communication may include:

name;
-
order number;
-
products to be returned;
-
date of receipt;
-
a clear statement of the intention to withdraw from the contract.
The consumer must return the products within the applicable legal period, following the instructions provided by Linho Puro.

21. 30-Day Commercial Returns Policy
In addition to the statutory withdrawal period, Linho Puro offers a commercial returns period of up to 30 days after receipt of the order.
Between the 15th and the 30th day, the return is subject to the commercial conditions set out in the Returns and Refunds Policy.
This additional policy does not reduce or replace the consumer’s statutory rights.
22. Condition of Returned Items
During the statutory withdrawal period, the consumer may handle the product only to the extent necessary to establish its nature, characteristics and functionality.
The consumer may be held liable for any reduction in the value of the product resulting from handling beyond what is necessary.
During the additional period under the 30-day commercial returns policy, the item may be required to:
-
not have been worn or used beyond trying it on;
-
not have been washed;
-
show no odours, stains or damage;
-
retain its tags;
-
be returned with all accessories;
-
be accompanied by proof of purchase.
The absence of the original packaging does not automatically remove the statutory right of withdrawal, although the customer must package the product appropriately to prevent damage during transport.
23. Return Costs
Where a return results from a change of mind or the exercise of the right of withdrawal, the direct return shipping costs are borne by the consumer, unless otherwise stated.
Where the item:
-
is damaged;
-
is not in conformity;
-
does not correspond to the item ordered;
-
was sent due to an error by Linho Puro,
the reasonable return costs will be covered by Linho Puro.
24. Refunds
Where the consumer validly exercises the right of withdrawal, all payments due will be refunded, including the cost of the standard delivery method offered by the store.
Additional costs resulting from the selection of a more expensive delivery method will not be refunded.
The refund will be made using the same payment method used for the purchase, unless otherwise agreed.
We may withhold the refund until we receive the products or until the consumer provides proof of shipment, whichever occurs first.
The bank or payment service provider may require a few additional days to make the funds available.
25. Exceptions to the Right of Withdrawal
The right of withdrawal may not apply, in particular, to:

products made according to the customer’s specifications;
-
clearly personalised products;
-
sealed products that are not suitable for return for health protection or hygiene reasons once opened, where applicable;
-
other products covered by a statutory exception.
Simply trying on an item of clothing with the level of care normally permitted in a physical store does not automatically result in the loss of the right of withdrawal.
26. Exchanges
Unless otherwise stated, we do not offer direct exchanges.
The customer must return the purchased item and place a new order for the desired size, colour or style.
The availability of the new product is only confirmed once the new order has been completed.
27. Legal Guarantee and Product Conformity
Products sold by Linho Puro benefit from the applicable legal guarantee of conformity.
A lack of conformity may exist where, among other circumstances, the product:

does not match the description;
-
does not possess the advertised qualities;
-
is not suitable for the usual purpose of products of the same type;
-
does not have the durability or functionality that may reasonably be expected;
-
does not correspond to the product ordered.
Where there is a lack of conformity, the consumer may be entitled to the remedies provided by law, including, depending on the legally applicable conditions:
-
repair;
-
replacement;
-
a proportionate price reduction;
-
termination of the contract.
The specific rights available depend on the nature of the lack of conformity, the feasibility and proportionality of each remedy and the circumstances of the case.
28. Product Care
The customer must follow the washing, care and use instructions displayed on the labels or product page.
Damage resulting from:
-
improper use;
-
washing contrary to the instructions;
-
normal wear and tear;
-
accidents;
-
changes made by the customer;
-
improper storage,
does not, in itself, constitute a lack of conformity attributable to Linho Puro.
This provision does not limit the consumer’s rights where the product is genuinely defective or not in conformity.
29. Content and Intellectual Property
The content made available on the website, including:

text;
-
photographs;
-
images;
-
videos;
-
graphics;
-
logos;
-
trademarks;
-
visual elements;
-
design;
-
website structure;
-
product descriptions,
is protected by copyright, industrial property rights or other legally applicable rights.
Its reproduction, distribution, modification, publication, commercial exploitation or use without prior authorisation is not permitted, except where allowed by law.
Accessing the website does not grant the user any licence or right over this content.
30. Reviews, Comments and Submitted Content
When the customer submits a review, comment, photograph or other content for publication, they declare that:

they are the author or have permission to use it;
-
the content is truthful based on their experience;
-
it does not infringe the rights of third parties;
-
it does not contain unlawful, offensive or misleading content;
-
it does not contain personal data relating to third parties without authorisation.
The customer grants Linho Puro a non-exclusive licence to display, reproduce and technically adapt that content on channels associated with the store, solely for the communicated purposes.
This permission does not transfer authorship of the content.
We may refuse or remove content that breaches the law, these terms or the rights of third parties.
31. Third-Party Links and Services
The website may include links, applications or features provided by third parties.
Linho Puro does not control external websites or services and is not responsible for their content, availability or practices.
Before using external services, users should review the relevant terms and privacy policies.
Complaints concerning products or services purchased directly from third parties must be addressed to the relevant provider.
32. Optional Tools
We may make tools or features provided by third parties available.
The use of these tools may be subject to:

the provider’s terms;
-
the provider’s privacy policy;
-
the creation of an external account;
-
consent to certain technologies.
Linho Puro does not exclude any liability that may legally be attributed to it in connection with the selection, integration or use of these tools.
33. Personal Data
The processing of personal data carried out through the store is governed by our Privacy Policy.
The use of cookies and other similar technologies is governed by the information provided in the cookie banner or cookie settings panel.
34. Errors and Inaccuracies
Typographical, technical or updating errors may occur in relation to:

prices;

promotions;
-
availability;
-
shipping costs;
-
delivery times;
-
product characteristics.
When we identify an error, we may correct it and update the information.
Where the error affects an order that has already been placed, the customer will be informed and given the option to confirm the order under the correct conditions or cancel it and receive a refund of the amounts paid.
The consumer’s statutory rights will not be affected.
35. Website Availability and Operation
We make every effort to keep the website accessible and secure but do not guarantee that it will operate continuously without interruptions or errors.
Access may be temporarily suspended for:

maintenance;

updates;
-
corrections;
-
security purposes;
-
resolution of technical issues;
-
circumstances beyond our control.
Website unavailability does not limit rights relating to orders that have already been entered into.
36. Limitation of Liability
Linho Puro is liable in accordance with the applicable legislation.
Nothing in these terms excludes or limits liability for:

death or personal injury caused by conduct that is legally attributable to Linho Puro;

wilful misconduct or gross negligence;

breach of mandatory legal obligations;

lack of conformity of products;

Linho Puro will not be liable for damage resulting exclusively from:

incorrect information provided by the customer;

failure to follow use or care instructions;

external services selected directly by the user;
-
unforeseeable events or circumstances beyond the company’s reasonable control.
37. Force Majeure
We will not be liable for delays or failures caused by events that cannot reasonably be controlled, including:

fires;

floods;
-
epidemics;
-
wars;
-
civil unrest;
-
general strikes;
-
widespread communication failures;
-
transport disruptions;
-
decisions by public authorities;

other force majeure events.
Whenever possible, reasonable measures will be taken to reduce the effects of the event and fulfil any outstanding obligations.

Communications relating to an order may be sent to the email address or telephone number provided by the customer.
These communications may include:

invoicing;

returns and refunds.
Promotional communications will only be sent in accordance with the rules described in the Privacy Policy.

40. Complaints
Consumers may submit a complaint using our contact details.
They may also use the Portuguese Electronic Complaints Book, in accordance with the applicable legal requirements.
Submitting a complaint does not affect the right to bring proceedings before the courts or use alternative dispute resolution mechanisms.
41. Alternative Consumer Dispute Resolution
In the event of a consumer dispute, the consumer may refer the matter to a competent Alternative Consumer Dispute Resolution entity.
Given the location of the company, the following entity may, in particular, have jurisdiction:
Centro de Informação, Mediação e Arbitragem de Consumo — Tribunal Arbitral de Consumo
Consumers should consult the official list of alternative dispute resolution entities to confirm which entity is competent based on their place of residence, the place of purchase and the nature of the dispute.
The former European Online Dispute Resolution Platform was discontinued on 20 July 2025. Its former address should therefore not be included in these terms.
42. Governing Law
These Terms and Conditions are governed by Portuguese law.
Where the customer is a consumer residing in another European Union country, the choice of Portuguese law does not deprive them of the protection provided by the mandatory provisions of the law of their country of residence, where applicable.
43. Competent Courts
Without prejudice to the use of alternative dispute resolution entities and mandatory consumer protection rules, disputes will be submitted to the courts with jurisdiction under the applicable law.
Nothing in these terms requires the consumer to use exclusively a court that does not have jurisdiction under the applicable legislation.
44. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be restricted or removed only to the extent necessary.
The remaining provisions will remain in force.
45. No Waiver
A failure to exercise a right immediately does not constitute a waiver of that right.
Any waiver will only take effect where it results from a valid and express declaration.
46. Changes to the Terms and Conditions
We may amend these Terms and Conditions to reflect:

changes in legislation;

changes to products or services;
-
operational changes;
-
new features;
-
changes to payment or delivery methods;
-
security requirements.
The updated version will be published on this page together with the date of the latest update.
Changes will not apply retrospectively to contracts already entered into, unless required by law or accepted by the parties.
